Víctor Ramírez

Victor's work at Olivares & Cía. focuses mostly on counseling, negotiating and prosecuting Industrial Property disputes (Nullity, Caducity and Infringement proceedings) before the Mexican Trademark and Patent Office, as well as on the respective appeal proceeding before the Courts of Law. He is also experienced in running, analyzing and reporting results of availability search for trademarks, slogans and commercial names; preparing and filing trademark, slogan and commercial name applications at the Mexican Trademark Office; trying cases relating to product labelling prosecuted before the Consumer’s Attorney General Office (PROFECO); and trying uniform dispute resolution procedures related to domain names.
In addition, he works on contractual transactions; advising and drafting license, assignment, franchise and transfer of technology agreements; as well as making of record these type of agreements before the Mexican Trademark Office when required.

Remarkable Cases
• Novartis. Successfully defended VOLTAREN Nuro trademark registration in Mexico against a cancellation action, allowing client to continue selling its well know pharmaceutical product under VOLTAREN Nuro trademark.  (2011) 
• Henkel. Recovered TURCO trademark from a local company who registered Henkel’s trademark in its name. (2010)
• Starwood Hotels and Resorts. Stopped the infringing use of W Hotel brand by an unauthorized third party, obtaining an useful precedent for client to sustain in future similar cases defending the well known mark W in Mexico . (2009)
• GlaxoSmithKline. Successfully defended our client against a potential Trademark infringement brought by Colgate for the use of the “Protección Total” toothpaste sub-brand minimizing the risk of potential liabilities. (2008)
• Rolex. Achieving Three Dimensional Trademark Protection for the ROLEX Oyster Watch in the Court of Appeal stage, obtaining for the client a valuable assent and useful tool against counterfeiting in Mexico. (2003)

When I'm not being a lawyer...
Víctor participates in continuing education by assisting and collaborating with various partners of the firm on research and essay drafts to be commented on seminars in various academic forums and occasionally replacing them in teaching classes in postgraduate courses on the Industrial Property field.
